TERMS OF THE CONTRACT OF CARRIAGE OF SKYLINE EXPRESS AIRLINES, LLC
Developed in accordance with the aviation rules "Rules of Air Transportation and Passenger and Baggage Services", approved by the Order of the State Aviation Service of Ukraine No. 1239 dated November 26, 2018, registered in the Ministry of Justice of Ukraine on February 8, 2019 with changes made by the orders of the State Aviation Administration Ukraine №1126 from 14.08.2020, №1543 from 01.10.2021.
LATEST CHECK IN TIME AND BOARDING AIRCRAFT
Passenger should arrive for registration at the airport not later than 2 hours before flight. Passengers and baggage check-in at the airport are stopped 60 minutes before international or domestic flight, the check-in on the airline’s website is 4 hours the departure time of the flight specified in the ticket.
Depending on peculiarity of airport and rules of carrier latest check-in can be other, but not earlier than 60 minutes before the scheduled time of departure of the flight.
More detailed information you can receive from the representative of the carrier or on the web-site www.skylineexpress.aero. Boarding aircraft is stopped 20 minutes before flight departure time. In case passenger breaks arrival time for registration or boarding aircraft, the carrier may deny boarding.
PERSONAL INFORMATION AND DOCUMENTS FOR JOURNEY
Within the limits set out by current legislation of Ukraine and countries of destination, the person who sells transportation (carrier, sales agent) must respect the privacy of the passenger. In this case, the passenger authorizes the Carrier to store personal information about themselves and provide their public authorities at their request or their employees, their agents, other carriers, providers of additional services for booking or reissue, receiving additional services, organization of lost baggage and warning systems / definition fraud shipping documents, providing information on arrival/departure of flight.
Passenger is responsible for receiving all necessary documents for journey: Visa, permissions, certificates etc., complying with all legislation concerning on entry to and exit from the country of departure, arrival and transit. Carrier isn’t responsible for consequence if passenger did not receive such documents or visa or failed to comply with out all mentioned legislation.
By requirement of the Airline the passenger should show the Airline’s authorized person, representative of relevant state authority all documents for departure, arrival and transit, about health status and other documents required by legislation and permit the carrier to make a copy and keep them or store the data contained in these documents. Airline may deny boarding if the passenger didn’t comply with applicable legislation or if the documents are inadequate.
Airline isn’t responsible for refusal of entry to the country.
REPEATED CONFIRMATION OF BOOKING
Airline may demand from passenger to make repeated confirmation of return fight. Flights using the procedure for return flight confirmation are set up by the Airline and published on the web-site. Passenger must be informed about necessity of the return flight confirmation during the issuance of ticket
The return flight confirmation is not required, if the return flight is supposed to be carried out in less than 72 hours or if the booking was made less than 72 hours before the time of scheduled departure.
If the passenger has several flight segments, then confirmation is made for each segment.
Non fulfillment of the Airline’s requirements by the passenger concerning repeated confirmation gives the right to the carrier to cancel unconfirmed booking not earlier than 72 hours before the time of scheduled departure.
TERMS OF CONTRACT
1. As used in this contract “ticket” which is called “passenger ticket and baggage check” including electronic ticket, given by the carrier (his agent), which includes conditions of the carriage and communication contract, together with the flight passenger coupons and “Carrier” means a business entity that provides services for the transportation of passengers by air;
“Electronic ticket” means the electronic document that includes printed Itinerary/Receipt, electronic coupons and if applicable, boarding document.
“International operations” – carrying when the departure and arrival points, (though take place stop of the carrying or reloading) are based either on the territory of 2 different countries or on the territory of one country, if station is provided on the territory of other country; Internal carrying – passenger of baggage transportation by the aircraft between points, situated on the territory of Ukraine.
2. Passenger ticket or baggage check are the confirmation/evidence of contract conclusion and contain its conditions. Absence, error in execution or loss of the passenger ticket or baggage check do not influence the force of the contract. The carrier undertakes to carry passenger and to the point of destination, giving to him the place and ordered class of service on board aircraft operating the flight, specified in the ticket. The passenger has to pay for the carriage and ordered service the fixed fare, airport charge and tax, and in case of carriage of baggage more than the established rate of free carriage baggage - for the carriage of this baggage.
Cases of ticket invalidation are specified in item 5., chapter 1, section III of the Rules for air transportation and passenger and baggage service, approved by the order of CAA Ukraine and Communications of Ukraine (26.11.2018 №1239, registered in Ministry of Justice of Ukraine 08.02.2019 №141/33112 with changes and additions made by the order of the State Aviation Administration №1126 from 14.08.2020).
3.Norms/rules of free carriage of registered baggage are set in accordance with by the carrier:
- economy class of service for flight less than 6 hours – 20 kg with the size of each place (sum of heights, width, length) – no more than 158 cm;
- economy class of service for flight more than 6 hours – 15 kg with the size of each place (sum of heights, width, length) – no more than 158 cm;
- business class - 40 kg (taking into account the requirements for the weight of one of the baggage in accordance with paragraph 3 of Chapter 1 of Section XI of the Rules for air transportation and passenger and baggage service) with the size of each place (sum of heights, width, length) – no more than 158 cm;
Child aged less than 2 years has the right of free carriage of one baggage place with weight less than 10 kg. (22 pounds), size of which is no more than 115 cm (45 inches). Rules for oldest children are the same as for adults.
The passenger has the right to carry, free of charge, over and above the free baggage allowance the items he holds with himself and does not put into baggage, in particular: a handbag, a folder for paper, a coat or a raincoat, a jacket, an umbrella or a stick, printed publications for reading during the flight, food for the child, necessary for the flight, a children's cradle (in the presence of a child under the age of 1), a children's pram, a wheelchair and / or cribs.
The common weight of all items must not be more than 7 kg.
4. The air carrier's name may be specified in the ticket reduced (ICAO code – UTN, IATA code - QU).
Full name of the carrier is “SKYLINE EXPRESS AIRLINES”, Limited Liability Company. The carrier’s address: 90500, Zakarpattia region, Tiachiv District, c.Tiachiv, Nezalezhnosti str., 90-A.
5. Agreed items of the stop are the points, mentioned in current ticket or in carrier’s schedule as points of stop on the route of passenger journey. Carriages, performed under this contract by few consecutive carriers are considered as one carriage.
6. The Airline issuing a ticket for carriage on the airline of another Airline, acts as the agent of the latter.
7. Registered baggage is given to the holder of baggage tag. In case of improper transportation of the baggage the relevant document is made, on the ground of this document claim in written form may be asserted to the carrier.
In case of improper transportation of the registered baggage passenger must send the claim to the carrier as soon as possible after exposure of the damage (loss of part of the baggage) and not later than 7 days after day of the registered baggage receipt. In case of delay of baggage transportation the claim must be asserted not later than after 21 calendar days from the date when the baggage was passed to the passenger’s disposal.
Claims about baggage loss are presented to the Airline after the baggage is recognized as lost. Baggage is recognized as lost if it is not found after 21 calendar days from the date, next after one when the baggage is to come to the point of destination. In this case the claim may be presented to the Airline during 2 years (for international transportation) and 3 years (for flights within Ukraine) after the date of baggage arrival to the point of destination or after the date when the aircraft had to come to the point of destination or after the date then transportation was ceased.
The claims are considered in order established by the Airline. The Airline is to deal with claim and inform the claimant about allowance or rejection of claim during 3 months of the date of its receipt, if transportation (according to which the claim was asserted) was performed fully by one carrier. If the other carriers took part in carriage, period of dealing with claim may be prolonged with 6 months.
Claims about the Airline's liability for improper transportation of passengers and / or baggage may be filed:
In accordance with terms established by current legislation without prior filing a claim to the airline.
Claims to the airline regarding improper transportation of passengers and / or baggage are sent by an email to [email protected] or to a postal address of the head office: Kyiv, Volodymyra Sosyury street, 6, "SKYLINE EXPRES Airlines" LLC.
8. Ticket, issued by the normal fare, is valid for carriage during a year from the date of beginning of the carriage provided that part of the ticket is used, or from the date of its issuance provided that not all ticket is used. Ticket, issued by special fare is valid for carriage only till the date mentioned in the ticket and under conditions established by rules of fare use of the airline.
9. Time of flight departure and type of aircraft established in the flight schedule or in other published flight schedules of the airline are not guaranteed and are not obligatory condition of the transportation contract. The airline has the right to change flight departure time and he must inform the passenger about that in time.
The airline has the right to change the type of aircraft without informing the passenger about that.
The airline has the right to delay or cancel the flight, both for commercial reasons and for reasons beyond his control. The airline must take all possible measures to prevent delay of passenger and baggage carriage.
In case of force-majeure (adverse weather conditions, extraordinary events during air traffic control, strike, rebellion, civil disturbance, embargo, wars, adverse actions, disturbance of peace, unsettled international relations, unexpected defects, which influence flight safety or other difficulties, that actually threaten or render impossible safety flight performance), the airline has the right to cancel or delay the flight without informing the passenger or to cancel reservation confirmed earlier .
In other cases the airline or its sales agent are to notify the passenger about delay or cancelling of the flight not later than 3 hours before the beginning of the registration.
The airline is not liable for errors and omissions in the timetables or other published schedules of flights of other carriers.
10. None of the agents, employees or representatives of the airline has the right to change or cancel the provisions of this contract.
THE airline PRESERVE THE RIGHT TO REFUSE CARRIAGE OF ANY PERSON WHO ACQUIRE A TICKET BY BREACH OF THE CURRENT LEGISLATION OR FARES, RULES OR CONDITIONS OF THE CARRIER.
INFORMING OF THE PASSENGER ABOUT HIS RIGHTS IN CASE OF REFUSAL OF CARRIAGE, CANCELLATION OR DELAY OF THE FLIGHT.
Passenger rights in case of refusal of carriage, cancellation or delay of the flight are regulated by the part XIII of the Air Code of Ukraine and part XV of the Rules for air transportation and passenger and baggage service.
Information about order of application of compensation and assistance, its volume can be received from the representative of the carrier or on the site of the carrier www.skylineexpress.aero .
INFORMING OF THE PASSENGER ABOUT LIABILITY LIMIT
Death and bodily injury of passengers. Baggage damage
The airline is responsible for harm, which caused death or bodily injury only if the incident which caused death or injury occurred on board the aircraft or during boarding or disembarkation of the passenger on / off board the aircraft.
The airline is responsible for damage sustained in case of destruction, loss or damage to checked baggage, only if the incident which caused the destruction, loss or damage to baggage, took place on board the aircraft or when the airline was responsible for maintaining the registered luggage, but the airline is not liable for damage to baggage caused by its defect or quality. For unchecked baggage, including personal belongings of passengers, the airline shall be liable if the damage is caused by its fault or the fault of its employees or handling agents.
If the Airline has acknowledged the loss of checked baggage or if the checked baggage has not arrived within 21 days of the date on which it was due to arrive, the passenger may claim the airline in accordance with the terms of the air transportation contract and the provisions of the Aviation Regulations.
Reimbursement of damage by airline caused by delay in air carriage
The airline is liable for damage caused by delay in the air carriage of passengers and baggage, but the airline is not liable for damage caused by delay if it proves that it and its employees and agents (sales and / or handling) take all possible measures in order to avoid the damage or that it (they) could not take such measures.
The airline ‘s liability for improper transportation is in any case limited to actual damages incurred by passengers.
Exemption from reimbursement
If the airline proves that the damage was caused or contributed by negligence, unlawful act or omission of the person claiming compensation, or the person from whom their rights are derived, the airline shall be fully or partially exempt from liability to the person claiming compensation in the amount, in which such negligence, unlawful act or omission caused or contributed to its occurrence.
If a claim for compensation in respect of damage which caused death or bodily injury of passenger is claimed by a person other than the passenger, the airline shall also be is completely or partially released from liability in so far as it proves that negligence, other unlawful act or omission of this passenger caused or contributed to its occurrence.
Compensation in case of death or bodily injury of the passenger
The Airline cannot exclude or limit its liability for damage that caused the death or bodily injury of the passenger under the conditions specified in the section “Death and bodily injury of passengers. Baggage damage” of this Contract, amounting to 128 821 SDR for each passenger.
The Airline is not liable for the damage that caused the death or bodily injury of the passenger and the amount of which exceeds the amounts specified in paragraph 1 of this section under the conditions specified in the section “Death and bodily injury of passengers. Baggage damage” of this Contract if the Airline proves that:
- such damage was not caused due to negligence or other unlawful act or omission of the airline or its employees or handling agents; or
- such damage was caused solely by negligence or other unlawful act or omission of a third party.
The airline must immediately, but not later than within 15 days after the identification of the individual entitled to receive compensation, make an advance payment, which must not be less than 16,000 SDR (excluding minor injuries).
Limits of liability for damage caused by delay
The liability of the airline for damage caused by delay in the carriage of passengers of any flights is limited to the amount of 5346 SDR for each passenger.The liability of the airline in the event of destruction, loss, damage or delay in the carriage of registered baggage is limited to 1288 SDR.
The Airline is not liable for any damage caused by a flight delay if it proves that it, its employees and handling agents have taken all necessary measures to avoid damage or that the use of such measures was impossible.
BAGGAGE
Baggage items weighing no more than 32 kg can be transported as checked baggage. Upon prior agreement with the Airline, baggage places of a larger size and weight may be accepted for carriage. Baggage, which does not meet the specified requirements, must be registered by the passenger for transportation as a cargo.
Norms of free transportation does not apply to:
- passengers goods, regardless of their name, the dimensions of which do not correspond to the sizes given above;
- TV sets, tape recorders, radio receivers weighing more than 10 kg in one place;
- flowers, plant seedlings, food greens, dried plants, branches of trees and shrubs of a total weight exceeding 5 kg;
- correspondence, which is accompanied by state messengers;
- animals (domestic or wild), birds, bees and other live animals, with the exception of the guide dog accompanying the blind.
Things that should not be included in the baggage:
- goods, objects, liquid and other substances that are capable of posing a significant risk to the health of passengers, flight safety or property of the carrier or other passengers during transportation, including explosive, compressed gases, corrosive materials, oxidants, radioactive materials, magnets , flammable materials, poisonous, harmful or irritant substances, as well as any other items and substances as defined in the “Technical Instructions for the Safe Transportation of Dangerous Goods by Air”, ICAO, Doc 9284-AN/905 as prohibited to transport on passenger aircraft:
- fragile, delicate things and things that are beating or perishable, money, keys, jewelry, electronic equipment, photo and video equipment, precious metal and silverware, technical documentation, business documents, securities, valuables, medicines, medical records, passports and other identification documents and samples;
- goods and items the carriage of which is prohibited by applicable laws of any country from, to or through the territory of which the flight will be operated;
- goods which are not suitable for transportation by their nature, weight, size, shape or smell;
- live animals and birds, except in cases provided for by the Rules for air transportation and passenger and baggage service.
Things which can be carried as checked baggage or as baggage according to the Airline’s prior consent: firearms, ammunition and weapons, including antique firearms and cold weapons, cutting and pricking objects.
The passenger has the right to include his household items, alcoholic beverages, non-radioactive medical items and toilet items and first-aid items in checked baggage, including containers with medical aerosols and other items and substances allowed for transportation in a limited number in accordance with “Technical Instructions for the Safe Transportation of Dangerous Goods by Air “(ICAO, Doc 9284-AN/905) and in the amount permitted by the relevant control bodies.
The Airline has the right to refuse to accept baggage as registered, if not properly packed in suitcases with locks or other appropriate containers, which ensure the safe transportation of baggage and its handling using conventional cargo handling equipment.
For any baggage that exceeds the established rates for free baggage, the payment is made at the appropriate baggage rate.
HAND LUGGAGE
Things that have weight and dimensions established by the Airline, which allow them to be safely placed in the cabin of the aircraft on baggage racks or under the seat of the chair, are accepted as hand luggage. the placement of hand luggage and the things permitted for carriage in all passages of the cabin of the aircraft is prohibited.
Please note: Hand luggage should not contain cutting and pricking objects: knives, scissors, needles, knitting needles and other sharp and cutting items. Also, it is prohibited to carry any liquids, suspension, creams, paste in a capacity of more than 100 ml (grams) in one vial (tube) to the aircraft in hand luggage. The total volume of such substances in hand luggage, packed in containers of up to 100 ml (grams), shall not exceed 1 liters (kg) per passenger.
